This information explains what happens if your child has been in hospital for more than 90 consecutive days
The Children Act 1989 and 2004 makes it a legal duty for all staff at Leeds Teaching Hospital to protect and promote the welfare of all children and young people to make sure they grow up happy and healthy.
Section 85 of the Children Act
Under section 85 of the Children Act 1989 and 2004, hospitals have a legal requirement to inform the local authority (Children Social Care) when a child has been in hospital for more than or likely to exceed 90 days. As this is a legal obligation, we do not require your consent to share this information.
- It places a duty on local authorities to check the safety and welfare of your child and offer help and support if you need it now and in readiness for their discharge from hospital.
- It provides a ‘safety net’ for vulnerable children who have been living away from home, and have been accommodated in the hospital for a long period.
- It is aimed at ensuring the safety and support needs of disabled children and the impact being in hospital, for an extended period, has on them and their families.
What will be shared?
The hospital let the local authority (Children Social Care) know about all children under 18 who have been an in-patient for 90 days or more.
Information we will share includes:
- Child’s full name, date of birth and address
- Date of and reason for admission
- Child’s parent/carers name and contact details
- Child’s GP
The nurse looking after your child will let you know when this information has been shared.
What happens next?
A children’s social worker may contact you to discuss your child’s needs and how they can help. They may offer to meet with you and complete an assessment. If you need this, a report will be written and shared with you by the social worker which should include a plan for when your child is ready to leave hospital.
